Terms and Conditions for Credit Health Report Services via Federal Bank

 

  • “Federal Bank” means Federal Bank Limited.
  • The  “Site” means any website, mobile site, or application of Federal Bank.
  • The  “Service/s” means, in relation to the Credit Health Report, any information, documents, assistance, or services provided to you through the Site.
  • “I”, “me”, “my”, “myself”, “Consumer/Customer” mean anyone who visits, accesses, or uses the Site or requests Services from Federal Bank through the Site.
  • “Bureau” shall mean a credit information company authorized under the laws of India to provide comprehensive credit information by collecting, collating, and issuing credit information pertaining to both commercial and consumer borrowers to a closed user group of members. In relation to provision of the Services mentioned herein, bureau shall mean  Equifax Credit Information Services Pvt. Ltd (EQUIFAX).

These Terms and Conditions, along with the  Terms of Use ,  Privacy Policy ,  Legal Disclaimer , and  Terms of Service , govern the provision of Services and the relationship between you and Federal Bank and form a legally binding agreement. Any violation of these terms may result in legal liability. If you do not agree to these terms, please do not access or use Federal Bank’s credit score and report services. By subscribing to the Services, you expressly agree to the following:

  1. I lawfully appoint  Federal Bank as my agent for the purposes including, but not limited to, receiving my credit information from the Bureau and keeping a record of changes in my credit information for the purpose of EQUIFAX Alert, as and when provided by Federal Bank, at its discretion, to deliver the Services I have subscribed to.
  2. By accepting these terms and conditions, I am providing “written instruction” to  Federal Bank to obtain my credit information from the Bureau. I further authorize Federal Bank to share my personally identifiable information with the Bureau to confirm my identity and obtain the credit information on my behalf.
  3. By clicking “I Accept”, you provide explicit and informed consent for Federal Bank to fetch your Credit Report (CCR) from Equifax after validating your request.
  4. I undertake that the information provided by me for availing the Credit Report is true, correct, and accurate and matches the details provided to banks and other credit institutions. I understand that Federal Bank reserves the right to reject my request form without specifying reasons. I acknowledge that incorrect or incomplete information may result in inaccurate reports or services, and Federal Bank shall not be held responsible.
  5. I understand that the Credit Report is generated based on my credit report from EQUIFAX (“EQUIFAX Report”) and the analysis is provided by Federal Bank. The report is provided on an “as is” basis, and Federal Bank is not required to verify the correctness of the information. I shall not hold Federal Bank accountable for the accuracy, completeness, fitness for a particular purpose, or non-infringement of the information provided. The analysis is based on assumptions applied by Federal Bank.
  6. I acknowledge that the report is for illustrative and informational purposes only and does not constitute professional advice or solicitation. The report may contain proprietary information of Federal Bank and is intended solely for the recipient. I shall not circulate the report to any other person or entity. I accept sole responsibility for actions taken based on the report and shall not hold Federal Bank liable for any financial or other losses.
  7. I understand that Federal Bank is acting only as a facilitator by providing a platform to access my credit information. Federal Bank does not warrant uninterrupted or error-free operation of the Site but will take reasonable efforts to correct any delays or issues.
  8. I acknowledge that I may receive notifications of personalized offers and/or product recommendations and agree to be contacted by Federal Bank through the communication channels and contact details I have provided.
  9. I understand that any third-party products/services distributed by Federal Bank are governed by third-party terms and conditions. I shall exercise due diligence before applying for such products or services.
  10. I agree that these terms and conditions may be amended from time to time without notice. Changes will be available on the Site. Federal Bank may amend or discontinue the Services at its sole discretion without prior notice or consent.
  11. Any disputes relating to the credit information must be raised directly with the respective Bureau via their website.
  12. Your CCR will be displayed securely on the Bank’s website and will be delivered only to your entered email address.
  13. We protect personal data using strong encryption in transit and at rest. Account identifiers shown within CCR are suitably masked. All data related to this service is processed and stored within India.
  14. Retention: We retain your credit information for a maximum of six months or until the purpose is fulfilled or you withdraw consent, whichever is earlier; thereafter the information is securely purged unless fresh consent is obtained.
  15. Withdrawal: You may withdraw your consent at any time by writing to dpo@federalbank.co.in. After ascertaining the request, we will purge stored copies (other than records we are legally obligated to retain).
  16. We maintain detailed audit logs of consent and CCR access events, including consent version, timestamp, masked IP/device details, and OTP event ID, for compliance and investigation purposes, for such period as stipulated in our internal policies

 

DISCLAIMER

Federal Bank  holds exclusive proprietary rights to the Credit Report. You shall not distribute, modify, transmit, reuse, report, or use the contents of the report for public or commercial purposes—including text, images, audio, and video, if any—without Federal Bank’s prior written permission.

The information, analysis, and opinions contained in this report have been compiled based on data obtained in good faith from sources believed to be reliable, which may vary from time to time. Federal Bank makes no representation or warranty, express or implied, that the use of such information will not infringe any intellectual property rights.

Nothing in this report shall be construed as a recommendation to use any product or process. The report may contain advice, opinions, statements, and recommendations; however, Federal Bank does not represent or endorse the accuracy or reliability of any such content. Reliance on these statements is at the sole risk of the recipient.

Federal Bank, its group companies, suppliers, service partners, agents, employees, licensors, consultants, officers, and directors accept no liability and will not be liable for any loss or damage—direct, indirect, special, incidental, consequential, punitive, or exemplary—including lost revenues or profits, loss of business or data, arising from the use or inability to use the report or associated services. This includes any defect, error, omission, interruption, imperfection, fault, or inaccuracy in the Credit Report or its contents, even if advised of the possibility of such damages.

All actions and decisions based on the report are the sole responsibility of the recipient.

The content, trademarks, service marks, trade names, icons, and logos contained in the report (“Marks”), including without limitation the terms “Federal Bank” and its logos, are proprietary to Federal Bank. Any unauthorized use is strictly prohibited.

Federal Bank expressly disclaims any implied warranties imputed by the laws of any jurisdiction. All disputes and legal matters shall be subject to the exclusive jurisdiction of the courts located in  Aluva, Kerala . All disputes shall be referred to arbitration as provided in the Terms and Conditions.

This service complies with RBI guidelines on information security and outsourcing of IT services, and the applicable data protection laws.

Terms and Conditions for Credit Information Access via Federal Bank

In connection with submission of the application for receiving my credit information offered by Equifax Credit Information Services Pvt. Ltd (EQUIFAX) (“Product”) through submission of request form (“Product Request”) via  Federal Bank  and delivery of the Product to  Federal Bank , I hereby acknowledge and agree to the following:

Federal Bank  is my lawfully appointed agent and has agreed to act as my agent for the purposes, including, without limitation, to receive the Product from  EQUIFAX on my behalf and use it in a manner consistent with the end-use policy of  Federal Bank  (“Federal Bank’s End Use Policy”) or the understanding between me and  Federal Bank  (“Terms of Understanding”), as the case may be, and  Federal Bank  has granted its consent for being appointed for the aforesaid purpose.

I grant my unconditional consent to  Federal Bank  to receive the Product from EQUIFAX on my behalf and use it in a manner consistent with  Federal Bank’s End Use Policy  or the Terms of Understanding, as the case may be. I hereby represent and acknowledge that:

  1. I have carefully read the terms and conditions of  Federal Bank’s End Use Policy and understood the same; or
  2. the Terms of Understanding in relation to the use of the Product has been agreed between me and  Federal Bank .

I consent to Federal Bank collecting the personal details I provide (Name, Date of Birth, PAN, Address, Email, Mobile), transmitting them securely to Equifax to fetch my credit report, displaying it to me, and retaining consent/audit logs. Limited analytics may be applied to present my report (e.g., score ranges, summary insights, visualization).

I hereby expressly grant unconditional consent to, and direct, EQUIFAX to deliver the Product to  Federal Bank  on my behalf.

I shall not hold EQUIFAX responsible or liable for any loss, claim, liability, or damage of any kind resulting from, arising out of, or in any way related to:

delivery of the Product to  Federal Bank .

 any use, modification or disclosure by  Federal Bank  of the contents, in whole or in part, of the Product, whether authorized or not.

any breach of confidentiality or privacy in relation to delivery of the Product to  Federal Bank .

any use made by  Federal Bank  which is contrary to  Federal Bank’s End Use Policy  or Terms of Understanding or otherwise.

I acknowledge and accept that:

 EQUIFAX has not made any promises or representations to me in order to induce me to provide the Product Request or seek any consent or authorization in this regard; and

the implementation of  Federal Bank’s End Use Policy  or Terms of Understanding is solely the responsibility of  Federal Bank .

I agree that I may be required to record my consent / provide instructions electronically and in all such cases I understand that by clicking on the "I Accept" button below, I am providing "written instructions" to  Federal Bank  authorizing  Federal Bank  to obtain my Consumer Credit Information from my personal credit profile from EQUIFAX. I further authorize  Federal Bank  to obtain such information solely to confirm my identity and deliver the Product to me. Further, in all such cases: “By checking this box and clicking on the ‘Authorize’ button, I agree to the terms and conditions, acknowledge receipt of EQUIFAX privacy policy and agree to its terms, and confirm my authorization for EQUIFAX to obtain my Consumer Credit Information.”

I understand that in order to deliver the Product to me, I hereby authorize  Federal Bank  to obtain my Consumer Credit Information from EQUIFAX.

By submitting this registration form, I understand that I am providing express written instructions for  Federal Bank  to request and receive information about me from third parties, including but not limited to a copy of my consumer credit report and score from consumer reporting agencies, at any time. I further authorize  Federal Bank  to retain a copy of my information for use in accordance with  Federal Bank’s  Terms of Use and Privacy Policy.

I UNDERSTAND THAT THE PRODUCT IS PROVIDED ON AN “AS-IS”, “AS AVAILABLE” BASIS AND EQUIFAX EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

I shall not sue or otherwise make or present any demand or claim, and I irrevocably, unconditionally and entirely release, waive and forever discharge  EQUIFAX, its officers, directors, employees, agents, licensees, affiliates, successors and assigns, jointly and individually (hereinafter “Releasee”), from any and all manner of liabilities, claims, demands, losses, suits, costs and expenses (including court costs and reasonable attorney fees) (“Losses”), whatsoever, in law or equity, whether known or unknown, which I ever had, now have, or in the future may have against the Releasee with respect to the submission of the Product Request and/or my decision to provide  EQUIFAX with the authority to deliver the Product to  Federal Bank . I agree to defend, indemnify, and hold harmless the releasee from and against any and all losses resulting from claims made against EQUIFAX by third parties arising from and in connection with this letter.

I agree that the terms of this confirmation letter shall be governed by the laws of India and shall be subject to the exclusive jurisdiction of the courts located in Aluva in regard to any dispute arising hereof.  EQUIFAX is entitled to assign its rights hereunder to any third person without taking my prior written consent.
